General warranty conditions

These warranty conditions are valid from 1 January 2023. The original terms and conditions apply to all agreements concluded before 1 January 2023
- The Seller guarantees that any defects that appear within 12 months (unless the product specification describes a longer warranty) after the invoice date will be repaired free of charge, with due observance of the articles below.
- The goods are in accordance with the requirements set out in the approved offer and specification. This warranty covers defects that occur during the warranty period of the product(s) in question, unless the damage is the result of Buyer’s use contrary to the installation instruction, improper use, or can otherwise be attributed to Buyer’s error. The warranty does not apply to consequential damage. Neither does the warranty apply if the defect is the result of the delivery or the work.
- The goods must be installed according to local regulations. The warranty only applies if the installation is carried out according to the installation instruction. If the installation instruction is not included in the first shipment, it must be requested from HATO BV before starting the installation.
- The Seller’s liability does not include work and costs associated with the removal or reinstallation of systems, unless specifically agreed with the Seller.
- The warranty excludes all forms of physical damage.
- If the Buyer changes or repairs the goods itself without the Seller’s permission, within the stated warranty period, the warranty will lapse with immediate effect and all subsequent costs will be borne by the Buyer. The foregoing also applies if the Buyer has had the goods changed or repaired by a third party.
- Transport damage, collision, stowage, loading and unloading, burglary, theft and chemical influence on plastics are excluded from the warranty. Defects or damage caused by lightning, abnormal voltage, water, fire, natural disaster, war, vandalism or misuse are also excluded.
- The warranty only applies if the product and a copy of the invoice are returned within 30 days of discovery of the defect. The Buyer pays the costs for returning the product.
The effective date of the warranty is the Seller’s invoice date. The warranty is at all times at the discretion of the Seller. Additional costs for on-site repairs/replacement and/or by third parties will not be reimbursed, unless explicitly agreed otherwise in writing. In the case of transport of materials, the Seller is responsible for the shipping costs to the address indicated on the invoice, i.e., the delivery address of the customer, provided the defect is covered by the warranty. At the request and at the expense of the customer, the Seller will arrange for the transportation of materials to the delivery address of a third party, provided the defect is covered by the warranty. An invoice will be sent for the material. As soon as it is clear that the defect is covered by the warranty, a credit note will be sent. - The provisions of these conditions are without prejudice to the Seller’s liability under the law.

The total warranty period of this product consists of 3 years full warranty + 5 years decreasing warranty. This 8-year warranty is issued on the basis of the prescribed specifications.

From the 4th year, a decreasing warranty applies. The decreasing warranty comes into effect from the moment the full warranty ends. From this moment on, a discount applies to the purchase of a replacement product.
The discount is calculated as follows:
(total warranty period - period already used) / total warranty period * current price of replacement product.
This warranty takes effect from the date of production unless it is conclusively established what the delivery date is.
Unless stated otherwise, Lumen maintenance is specified based on L70B50. This means that at the end of the specified duration, 50% of the lamps still have at least 70% of the specified Lumen output.
